By utilizing this NEHP website, User acknowledges that he or she has read, understood and agrees to comply with the terms and conditions stated within this Agreement.

NEHP may amend these terms and conditions at any time. User's continued use of this website constitutes acceptance of the terms and conditions stated at the time of use.

NEHP's trademarks and trade dress may not be used in connection with any product or service that is not NEHP's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits NEHP. All other trademarks not owned by us that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by NEHP.

Disclaimers and Limitations of Liability

The Site is provided on an “AS IS,” “as available” basis. Neither NEHP, nor any of its Associates warrant that use of the Site will be uninterrupted or error-free. Neither NEHP, nor its Associates warrant the accuracy, integrity, or completeness of the Content provided on the Site or the products or services offered for sale on the Site. Further, NEHP makes no representation that Content provided on the Site is applicable or appropriate for use in locations outside of the United States. Under no circumstances shall NEHP or its Associates be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use the Site, including but not limited to reliance by a user on any information obtained at the Site, or that result from mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from acts of God, communications failure, theft, destruction or unauthorized access to Overstock.com records, programs or services. The foregoing limitation of liability shall apply whether in an action at law, including but not limited to contract, negligence, or other tortious action; or an action in equity, even if an authorized representative of Overstock.com has been advised of or should have knowledge of the possibility of such damages. User Conduct

User agrees that all the information posted or accessed by User will be used only for informational or educational purposes. There will be no commercial or other unauthorized use of interactive features. User will not engage in any conduct or action that is prohibited by law or violates and federal, state, or local laws. Users of this site also agree not to distribute, post, publish or otherwise communicate any content which defames, abuses or threatens others, which is hateful or racially offensive, or which contains vulgar, obscene or indecent language or images, or which contains unauthorized copyrighted material or infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.

Shipping Limitations & Risk of Loss

When an order is placed, it will be shipping to an address designated by the purchaser as long as that shipping address is compliant with the shipping restrictions contained on this Web Site. All purchases from this Web Site are made pursuant to a shipment contract. As a result, risk of loss and title for items purchased from this Web Site pass to you upon delivery of the items to the carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments.

Pricing

Prices and availability of products on the Site are subject to change without notice. Errors will be corrected when discovered. Our Site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our Site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a product's correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you. If a product's correct price is higher than the price stated on our Site, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection. We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you an Order Confirmation or a Shipping Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a pricing error.

On occasion, you may be able to place a product in your shopping cart and submit your order for processing, but your order is subsequently cancelled due to unavailability of product. You acknowledge that products may sell quickly and there may be a short period of time after an order has been submitted, but where the product is no longer available. You agree that we may cancel your order after you have received an Order Confirmation without penalty.

Return Policy

Items purchased from NEHP can be returned for merchandise only, no cash. Merchandise must be returned within 10 working days for apparel and gear and no returns on Recovery items. In order to be returned, merchandise must be in like-new, 100% saleable condition and in original manufacturers packaging. Time for return, if purchased from the Web Site, starts when the shipping provider records the delivery of the merchandise to the customer not from the time purchased not the Web Site. Returns for in store purchases are handled by our retailers.

Return Authorization number is required to return merchandise. Call 1-877-MY-FLUID (1-877-693-5843) for an assigned Return Authorization number. NEHP will pay for return on defective apparel and gear all other returns must be paid for by the User.

Guarantee on Products

NEHP holds a 100% guarantee's for any manufacturer defects on apparel and gear sold on the Web Site. See Returns Policy for replacement, time and return instructions. No guarantee on Recovery products.

Sales Tax

If the merchandise is shipped within the state of California 8.5% will be applied to all purchase totals unless a valid signed resale ticket is on file with NEHP.

Payment Options

NEHP accepts all credit cards, debit cards, PayPal payments (U.S. Only), delayed shipment billing, and electronic checks (Telecheck). The User can purchase using our online shopping cart or through telephone, fax or mail using Virtual Terminal.

Cancelation Policy

We reserve the right to cancel your order at any time before we have accepted it and we may rescind our acceptance and cancel your order where there has been an obvious error in price or where the product is no longer in our or our third party fulfillment provider's inventory.

Back Orders

We anticipate no product will be back ordered more than 30 days. As soon as the product becomes available NEHP will ship it to the User.

Promotions/Coupons

NEHP reserves the right to refuse promotional pricing and Coupons redeemed by all customers. No Promotions are valid after their posted time limit. Coupons can only be used by the Customer they are issued too unless otherwise stated on the Coupon.

Use of Information and Privacy

Other than personally identifiable information, which is subject to this Web Site's Privacy Statement, any material, information, suggestions, ideas, concepts, know-how, techniques, questions, comments or other communication you transmit or post to this Web Site in any manner ("User Communications") is and will be considered non-confidential and non-proprietary. We and our respective affiliates and our or their designees may use any or all User Communications for any purpose whatsoever, including, without limitation, reproduction, transmission, disclosure, publication, broadcast, development, manufacturing and/or marketing in any manner whatsoever for any or all commercial or non-commercial purposes. We may, but are not obligated to, monitor or review any User Communications. We will have no obligation to use, return, review, or respond to any User Communications. These Terms and Conditions supersede any other agreement between the User and NEHP or its Associates to the extent necessary to resolve any inconsistency or ambiguity between them.
